What is a Big League Clubz?: Ham n’ Turkey, Chick n’ Turkey and Beef n’ Bacon are brand new Big League Clubz sandwiches at participating Schlotzsky’s restaurants. To celebrate their rookie season, we created this fun baseball themed Sweepstakes.

Who can participate in the Big League Clubz Sweepstakes?: This Sweepstakes runs March 2 to May 31, 2009 and is open to legal residents of the 50 United States and D.C. who are age 13 or older at the time of entry. For more details and restrictions, see the Official Rules below.
What can I win?: The Grand Prize is a trip for two to St. Louis for the baseball festivities for July 14, 2009 and includes hotel, airfare and $2,000 in spending cash! There will also be weekly and instant winners during the sweepstakes who could receive baseball gear, fantasy baseball teams from Sim Dynasty or other cool prizes like gift cards.
Does it cost anything to enter?: Nope! It’s completely free and no purchase is necessary.
How can I get more entries?: There are multiple ways to gain additional entries. See the Official Rules below for full details. You receive one initial entry by registering online. You can also receive bonus entries by telling your friends about the sweepstakes (drafting them to be a part of your virtual baseball team), playing the baseball game on the site and downloading the Baseball Ticker. You can receive an additional entry every day by returning to the site and logging in.
How do I get a mini-bat?: To find Schlotzsky’s locations, click on our store locator at the top of the page. When you visit a participating Schlotzsky’s, you can try one of the new Big League Clubz sandwiches. There are three different collector style baseball cards (one for each sandwich). Collect any three cards and upload a photo of yourself holding the cards to this site. The first 1,000 fans to successfully upload will win a personalized mini-bat which will be shipped to them on or about June 30, 2009. For more information, see the Official Mini-Bat Rules below. Big League Clubz Sweepstakes
Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility: The Big League Clubz Sweepstakes (the “Promotion”) is open only to legal residents of the fifty (50) United States (including District of Columbia) who are at least thirteen (13) years old at the time of entry. Void in Guam, Puerto Rico, the U.S. Virgin Islands, and other U.S. territories and possessions and where prohibited by law. Employees of Schlotzsky’s Franchise LLC, Matrixx Productions, Inc. or any of their respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Promotion and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible. The Promotion is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Administrator’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Promotion consists of a sweepstakes (the “Sweepstakes”).
2. Sponsor and Administrator: Sponsor: Schlotzsky’s Franchise LLC, 200 Glenridge Point Parkway, Suite 200, Atlanta, Georgia 30342. Administrator: Matrixx Productions, Inc. 3122 Santa Monica Blvd. Ste. 201, Santa Monica, CA 90404.
3. Timing: The Promotion begins on March 2, 2009 at 12:00 a.m. Eastern Time (“ET”) and ends on May 31, 2009 at 11:59 p.m. ET (the “Promotion Period”). Sponsor’s computer is the official time keeping device for this Promotion.
4. How to Enter (There are three ways to enter.): Website: To enter online, visit www.bigleagueclubz.com (the “Website”) and access the online entry form. You will receive one (1) entry into the Sweepstakes upon successful completion and submission of the entry form.

Following a successful entry at the Website, each entrant will have the opportunity to share information about the Sweepstakes (“Tell-A-Friend”) with up to ten (10) friends by providing up to ten (10) valid, unique email addresses. Each friend must be thirteen (13) years of age or older and consent to receiving such emails. For each qualifying email address provided via “Tell A Friend”, the entrant will receive additional entries into the Sweepstakes for a total of up to ten (10) possible additional entries via “Tell-A-Friend”.

Each entrant will also have the opportunity to download a baseball scores widget via the Website. For downloading the widget, the entrant will receive one (1) entry into the Sweepstakes. During the Promotion Period, special information and promotions will be displayed within the widget.

Each entrant will also have the opportunity to play a baseball themed advergame via the Website. Completing various levels in the game will also earn the entrant additional bonus entries into the Sweepstakes.

Each entrant that returns to Website during Promotion Period can receive one (1) additional entry into the Sweepstakes for each day.

By text: To enter via text message, send a sweepstakes keyword via cellular short message service with the entry code to 30364. Standard text messaging rates apply. Each entrant will receive one (1) entry into the Sweepstakes upon successful submission of the text message. Limit: One (1) entry per person via texting during the Promotion Period. Only the first entry via text message from a unique cellular telephone number will be accepted and receive and entry. Additional attempts to enter will be rejected.

By mail: To enter by mail, please hand-print your full name, address (including city, state and zip code), daytime telephone number (including area code), date of birth and email address (optional) on a 3 ½” x 5” card and mail in an envelope with proper postage affixed to: Big League Clubz Sweepstakes c/o Matrixx Productions Inc., 3122 Santa Monica Blvd. Ste 201, Santa Monica, CA 90404. Mail in entries must be postmarked by May 22, 2009 and received by May 31, 2009 to be eligible. Entries generated by a script, macro or other mechanical or automated means will be disqualified. The Promotional Entities are not responsible for printing errors or for stolen, lost, late, illegible, inaccurate, incomplete, damaged, garbled, delayed, postage due or misdirected entries. All mail-in entries become the property of Sponsor and none will be returned. Proof of mailing does not constitute proof of delivery.

For All Entries: Limit of 105 entries per person, during the Promotion Period regardless of method of entry. Multiple participants are not permitted to share the same email address. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant’s plays and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. All entries become the sole and exclusive property of Sponsor or Administrator and will not be returned. Administrator reserves the right to contact entrants and all other individuals whose email address is submitted as part of this promotion.
5. Winner Selection:: Instant Win: Ten (10) Instant Winners will randomly be selected during the Promotion Period. Upon successful submission of the entry form on the Website or of successful transmission of their first text message, entrant may be randomly chosen as an instant winner. Each Instant Winner will receive a Regular Prize.

Weekly Drawing: Ten (10) Weekly Winners will be randomly selected from all eligible entries received between the start of the Promotion Period and 11:59 p.m. ET of the date immediately preceding Regular Prize drawings, which will be conducted on or about March 9, 2009, March 16, 2009, March 23, 2009, March 30, 2009, April 6, 2009, April 13, 2009, April 20, 2009, April 27, 2009, May 4, 2009 and May 11, 2009. Each Weekly Winner will receive a Regular Prize.

Grand Prize Drawing: On or about June 1, 2009 the Grand Prize winner will be randomly selected from all eligible entries received during the Promotion Period.

The potential winners will be notified by email, text message or mail depending upon the contact information given at the time of entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If, despite reasonable efforts, a potential winner does not respond within three (3) days of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected. Sponsor may successively attempt to contact up to two (2) potential winners of an applicable Instant Win or Weekly Prize, and up to five (5) potential winners of the Grand Prize, in accordance with such procedure, and if there is still no confirmed winner of the prize in question after such attempts have been made, such prize may go unawarded. The Grand Prize winner will be required to execute an Affidavit of Eligibility, a Liability Release, and (where legal) a Publicity Release (collectively, “Prize Claim Documents”). If a winner is not of legal age of majority in his or her state of residence (a “minor”), at Sponsor’s option, the applicable prize either will be awarded in the name of the parent or legal guardian of the minor winner, or the parent or legal guardian of the minor winner will be required to ratify and sign the Prize Claim Documents. If any potential winner (or such minor winner’s parent or legal guardian) fails or refuses to sign and return all Prize Claim Documents within five (5) days of prize notification, such winner may be disqualified and an alternate winner may be selected. The travel companion for Grand Prize winner must also sign applicable Prize Claim Documents prior to any travel document being issued.
6. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY ADMINISTRATOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION.
7. Verification of Potential Winners: Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The Grand Prize winner will be notified by email, telephone, or registered mail after June 1, 2009. The Grand Prize winner will be required to sign and return to Administrator, an affidavit of eligibility, and liability/publicity release (except where prohibited) in order to claim his/her prize if applicable. If a potential winner of any prize cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. In the event that a potential winner of a sweepstakes prize is disqualified for any reason, Administrator may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
8. Prizes: Grand Prize: ONE (1) GRAND PRIZE: Winner will receive a 3-day/2-night trip for winner and one (1) travel companion to St. Louis, Missouri, including round-trip air transportation to/from gateway airport nearest winner’s home (must be located in Continental United States; if prize winner lives outside the Continental United States, the prize winner is solely responsible for getting to the Continental United States) to St. Louis, Missouri (coach class airfare will be provided for winner and travel companion) (if winner resides within one hundred and thirty (130) miles of St. Louis then ground transportation may be substituted in lieu of air transportation and no additional compensation or substitution will be awarded for difference in prize value), hotel accommodations (standard room/double occupancy), and $2,000.00 in miscellaneous expenses including going to a baseball game. Winner must commence the trip on July 13, 2009. If winner is unable to travel within the time period required, the prize will be forfeited. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, personal charges at lodging, security fees, taxes or other expenses or incidentals are the responsibility solely of winner. Travel companion must travel on same itinerary and at the same time as the winner; winner and travel companion are responsible for obtaining all necessary travel documents. If winner is a minor the travel companion must be the prize winner’s parent or legal guardian. All costs and expenses associated with prize acceptance and use not specified herein as being awarded, including but not limited to lodging, transportation costs, meals, gratuities and other expenses incurred by accepting the Grand Prize are the sole responsibility of the Winner. The Approximate Retail Value (“ARV”) of Grand Prize is $4,000.00. Actual value may vary based on airfare fluctuations and partner pricing. Any stated difference between the approximate value and actual value of Grand Prize or any substituted prize will not be awarded.

Instant Win / Weekly Drawing Prizes: There will be ten (10) instant winners and the ten (10) weekly winners. Each one will receive a Regular Prize consisting of either apparel, baseball gear, electronics, Sponsor-branded promotional materials such as t-shirts and gift certificates, fantasy baseball website memberships or other products as determined by Sponsor in its sole discretion. The ARV of each Regular Prize is Fifty Dollars ($50.00).

For All Prizes: One instant win / weekly prize per person. No cash equivalent for the prizes, prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute any listed prize for one of equal or greater value for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning a prize depend on the number of eligible entries received during the Promotion Period. TOTAL ARV OF ALL PRIZES: $5,000.00.

All trademarks and service marks related to the prizes are the property of their respective owners and no sponsorship, endorsement or affiliation is implied by their use in these Official Rules or in the Promotion.
9. Entry Conditions and Release: By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Administrator and/or the Sweepstakes judges which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless the Sponsor and the Administrator and each of their respective parent, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes and Promotion, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes and Promotion, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Sponsor and the Administrator from and against any and all claims, expenses, and liabilities (including reasonable attorneys fees) arising out of or relating to an entrant’s participation in the Sweepstakes and Promotion and/or entrant’s acceptance, use or misuse of prize.
10. Publicity: Except where prohibited, participation in the Promotion constitutes winners’ consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
11. General Conditions: Administrator reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Administrator’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Administrator in its sole discretion. Administrator reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
12. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes play, provided that if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
13. Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than those concerning the administration of the Sweepstakes or the determination of winners, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate Georgia State Court located in Fulton County, Georgia; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules (whether of the State of Georgia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Georgia.

15. Promotion Results: To obtain a copy of the winners list, send a self-addressed stamped envelope to Big League Clubz Sweepstakes c/o Matrixx Productions Inc., 3122 Santa Monica Blvd., Ste. 201, Santa Monica, CA 90404. Winner’s list requests will only be accepted after the end of the Promotion Period and no later than July 31, 2009. These Official Rules will be posted at the Website during the Promotion Period.

Collect any three cards and visit BigLeagueClubz.com. Complete the online redemption form and upload a picture of yourself holding your three cards into our Big League Clubz community. No purchase is necessary. To obtain a free card, please hand-print your full name, address (including city, state and zip code), daytime telephone number (including area code), date of birth and email address (optional) on a 3 ½" x 5" card and mail in an envelope with proper postage affixed to: Schlotzsky’s Mini-Bat Promotion c/o Matrixx Productions Inc., 3122 Santa Monica Blvd. Ste 201, Santa Monica, CA 90404. One card will be sent per letter received. Please allow 2 weeks to receive your card. Schlotzsky’s Franchise LLC and Matrixx Productions, Inc.
